El Tribunal Colegiado<\/strong> de La Altagracia dict\u00f3 sentencia<\/strong> este martes contra V\u00edctor Manuel Kery<\/strong>, conocido como \u201cEl Pastor\u201d, y Robinson Peguero<\/strong>, alias \u201cEl Profeta\u201d, hallados culpables de delitos de agresi\u00f3n sexual<\/strong> en perjuicio de varias v\u00edctimas<\/strong>, en un proceso judicial que se conoci\u00f3 a puertas cerradas.<\/p>\n\n\n\n

La calificaci\u00f3n jur\u00eddica<\/strong> aplicada al caso fue sustentada en los art\u00edculos 330 y 333<\/strong> del C\u00f3digo Penal<\/strong> Dominicano, en sus literales B, D y E, los cuales tipifican y agravan las conductas relacionadas con agresi\u00f3n sexual<\/strong>.<\/p>\n\n\n\n

Seg\u00fan explic\u00f3 el abogado Jos\u00e9 Alfredo Javier<\/strong>, representante de una de las v\u00edctimas<\/strong>, el tribunal<\/strong> retuvo la falta de agresi\u00f3n sexual<\/strong> agravada, y no violaci\u00f3n, al imputado V\u00edctor Manuel Kery<\/strong>.<\/p>\n\n\n\n

\u201cSe trata de una variaci\u00f3n jur\u00eddica<\/strong> basada en los elementos probatorios<\/strong> presentados en juicio<\/strong>. La calificaci\u00f3n fue modificada por aspectos muy internos del caso, raz\u00f3n por la que este se conoci\u00f3 a puertas cerradas\u201d, detall\u00f3 el jurista.<\/p>\n\n\n\n

En ese contexto, el tribunal<\/strong> impuso a Kery una pena de 10 a\u00f1os<\/strong> de reclusi\u00f3n, as\u00ed como el pago de una indemnizaci\u00f3n de dos millones de pesos<\/strong> a favor de la v\u00edctima<\/strong>.<\/p>\n\n\n\n

El abogado Javier<\/strong> se\u00f1al\u00f3 que la condena<\/strong>fue dictada con base en la calificaci\u00f3n de \u201cagresi\u00f3n sexual<\/strong> agravada\u201d, que representa la pena m\u00e1xima<\/strong> dentro de ese tipo penal.<\/p>\n\n\n\n

En cuanto a Robinson Peguero<\/strong>, alias \u201cEl Profeta\u201d, fue hallado culpable de agresi\u00f3n sexual<\/strong> simple, recibiendo una condena de cinco a\u00f1os<\/strong> de prisi\u00f3n. El abogado Javier<\/strong>indic\u00f3 que la decisi\u00f3n se bas\u00f3 en los elementos probatorios<\/strong> que pudieron ser demostrados durante el juicio<\/strong>.<\/p>\n\n\n\n

El abogado tambi\u00e9n expres\u00f3 su inconformidad<\/strong> con la severidad de las penas<\/strong> establecidas por el C\u00f3digo Penal<\/strong>vigente.<\/p>\n\n\n\n

\u201cNo es justo que dentro de 10 y 5 a\u00f1os este tipo de sujetos est\u00e9 en las calles tomandonuevas<\/strong> v\u00edctimas<\/strong>. Casos como este deber\u00edan conllevar penas de hasta 40 a\u00f1os\u201d, sostuvo.<\/p>\n\n\n\n

Por su parte, Ander Severino<\/strong>, abogado de otra de las v\u00edctimas<\/strong>, valor\u00f3 positivamente<\/strong>la sentencia<\/strong>.<\/p>\n\n\n\n

\u201cEstamos conformes. Todas las pruebas presentadas<\/strong> respaldan la decisi\u00f3n<\/strong> que el tribunal<\/strong> ha adoptado el d\u00eda de hoy\u201d, afirm\u00f3.<\/p>\n\n\n\n

Otro de los representantes legales<\/strong>, Jos\u00e9 Rivera, tambi\u00e9n se mostr\u00f3 satisfecho con el fallo.<\/p>\n\n\n\n

\u201cEl tribunal<\/strong> hizo una sabia apreciaci\u00f3n de las pruebas. Aunque hubi\u00e9semos querido una pena mayor, el C\u00f3digo Penal<\/strong> no lo permite\u201d, coment\u00f3.<\/p>\n\n\n\n

Rivera resalt\u00f3 la gravedad del caso<\/strong>, se\u00f1alando que los acusados eran figuras religiosas<\/strong> llamadas a proteger a sus seguidores<\/strong>.<\/p>\n\n\n\n

\u201cFue un proceso bochornoso<\/strong>. Las pruebas claves fueron los testimonios ofrecidos<\/strong> por las v\u00edctimas<\/strong> en c\u00e1mara Gesell<\/strong>, donde relataron de forma clara y precisa los hechos\u201d, enfatiz\u00f3.<\/p>\n\n\n\n

Defensa de Peguero<\/strong> apelar\u00e1 decisi\u00f3n<\/strong><\/h2>\n\n\n\n

Dionisio B\u00e1ez, abogado de Robinson Peguero<\/strong>, expres\u00f3 su desacuerdo con la condena<\/strong> y anunci\u00f3 que apelar\u00e1 la decisi\u00f3n del tribunal<\/strong>.<\/p>\n\n\n\n

\u201cSolo dos declaraciones de las v\u00edctimas<\/strong> en c\u00e1mara Gesell<\/strong> fueron utilizadas como prueba, y en ninguna se se\u00f1ala a mi defendido como agresor o violador\u201d, indic\u00f3.<\/p>\n\n\n\n

Seg\u00fan B\u00e1ez, las grabaciones muestran<\/strong> que las v\u00edctimas<\/strong> no vinculan directamente a Peguero con los actos cometidos<\/strong>, por lo que, en su criterio, el tribunal<\/strong> debi\u00f3 emitir una absoluci\u00f3n total<\/strong> por falta de pruebas.<\/p>\n","protected":false},"excerpt":{"rendered":"
